Welcome to our online space. By accessing, purchasing, enrolling in, or participating in any program, membership, course, event, or digital product offered through Kim Bienia LLC, you agree to these Terms & Conditions. Please read them carefully before using our site or services.
1. General Use
This website and all associated platforms (including Kajabi, Zoom, and third-party integrations) are owned and operated by Kim Bienia LLC.
You must be at least 18 years old to make a purchase or create an account. By using this site, you confirm that you are legally capable of entering into binding agreements.
2. Intellectual Property & Content Protection
All content, including but not limited to written materials, videos, images, meditations, trainings, PDFs, workbooks, brand assets, and course content, is the exclusive intellectual property of Kim Bienia LLC.
You are granted a personal, limited, non-transferable license for private use only.
You may not reproduce, distribute, share, teach, republish, post, or sell any materials without express written consent from Kim Bienia LLC.
Unauthorized use or distribution of content may result in immediate termination of access and potential legal action.
3. Community Standards
Whether engaging in a private mentorship, online course, or community forum (such as The Inner Temple or other group programs), you agree to:
Respect others’ privacy and confidentiality.
Refrain from harmful, harassing, or discriminatory behavior.
Participate responsibly and with self-awareness.
Violation of these community standards may result in removal from programs or communities without refund.
4. Payment Terms
All prices are listed in U.S. dollars unless otherwise stated.
You agree to pay all fees associated with your chosen product or service at the time of purchase.
Payment plans, if offered, must be completed according to schedule; failure to make payments may result in suspension or removal from the offering.
All payments are processed securely through trusted third-party platforms such as Stripe, PayPal, or Kajabi Payments.
5. Refund Policy
Because our products and services include instant access to digital materials, online content, and intellectual property, all sales are final unless otherwise explicitly stated in the specific program agreement.
Refunds are not provided for:
Digital downloads or courses
Memberships once a billing cycle has begun.
Missed live sessions or workshops.
Exceptions may be made in rare cases at the sole discretion of Kim Bienia LLC.
6. Cancellation & Memberships
If you participate in an ongoing membership (such as The Inner Temple), you may cancel at any time by following the instructions in your account settings or billing portal.
Cancellations must be completed by the member; we are unable to process them manually.
Access remains active until the end of your billing cycle.
Refunds are not issued for partial months or unused time.
7. Pausing / Freezing Memberships
You may request one membership freeze per 12-month period for up to 60 days to retain your current rate.
If additional freezes are requested, your membership will be canceled, and reactivation will occur at the current rate.
8. Health & Safety Disclaimer
The practices, teachings, and services provided by Kim Bienia LLC may include yoga, meditation, breathwork, mindfulness, and spiritual or energetic guidance.
By participating, you acknowledge and agree that:
You are voluntarily engaging in these practices at your own risk.
You have consulted with your physician before beginning any physical or energetic practice.
You are responsible for listening to your body and practicing within your limits.
You release Kim Bienia LLC, its instructors, affiliates, and partners from all liability arising from participation in any class, event, or program.
9. Results Disclaimer
We make no guarantees regarding specific outcomes or results.
All courses, trainings, and mentorships are educational and transformational in nature; your results depend on your personal effort, circumstances, and consistency.
10. Use of Testimonials and Case Studies
By participating in programs or communities under Kim Bienia LLC, you agree that anonymized insights, testimonials, or outcomes may be referenced for marketing, educational, or promotional purposes.
If we wish to use your name, likeness, or identifiable story, we will always seek your written consent first.
11. Technology and Access
You are responsible for maintaining your device, internet connection, and login credentials.
We are not responsible for technical issues, outages, or third-party service interruptions (Kajabi, Zoom, etc.).
We reserve the right to update or modify offerings, prices, and access terms at any time.
12. Termination of Access
We may suspend or terminate access to any program, course, or community for violation of these Terms or disruptive behavior.
No refunds will be issued in such cases.
13. Privacy
We respect your privacy. Personal information collected through this website is handled in accordance with our Privacy Policy, which outlines how your data is stored, used, and protected.
14. Limitation of Liability
To the fullest extent permitted by law, Kim Bienia LLC is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of our site, products, or services.
You agree that our total liability will not exceed the total amount paid by you for the product or service in question.
15. Governing Law
These Terms & Conditions are governed by the laws of the State of New York, USA, and any disputes shall be resolved in Suffolk County, New York.
